Pixelmon Brasil is a network of Minecraft servers offering alternative game modes developed by the network's own programmers. Pixelmon Brasil is not affiliated with Mojang, the company that created the game Minecraft and is responsible for its commercialization. The terms and conditions below must be read carefully and attentively. By proceeding with the purchase process and confirming your acceptance, or by entering one of our servers to which these terms apply, you agree to their validity. Should you disagree with the terms, you need only refrain from proceeding with the purchase process and from taking part in our servers, thereby not joining our community. These terms are directed at the end user of our services, provided they are of legal age, or at their legal guardian.
I. LICENSE OF USE
Access to the Pixelmon Brasil servers may be gained through the Multiplayer option in the Minecraft software. Simply add the IP address pixelmonbrasil.com.br to your server list and connect. On the client's first access, it will be necessary to create an account and register a secure password. Each account is defined exclusively by the nickname (the user's alias) chosen by the user upon first access.Accordingly, changing the nickname directly entails changing the account. Due to the way we register accounts, it is impossible to change your nickname while keeping your information. For this reason, it is not possible to transfer products between accounts.II. REQUIREMENTS
In order for the user to enjoy our servers and be part of our community, there are certain requirements.Minimum system requirements: the user's computer must meet the minimum hardware and software requirements to download the game “Minecraft”, install the software and make use of it, and access our servers.Acceptance of the Terms of Service: the user must read and accept the terms of service in their entirety in order to access our servers.Registration: the user must register on our server through Minecraft. Registration is essential, as access is granted by means of the account and password defined at this moment. It is necessary to register a security e-mail address for possible account recovery should it be needed.III. ACCOUNTS
Accounts are essential for the use of our services, the registered account being fundamental for accessing the server, acquiring products, interacting with the community and other functions; the website and Discord, however, may be viewed by observers without the need for registration.Eligibility: The creation of accounts on our network is available only to natural persons, and by agreeing to these terms, you attest that you are over 18 years of age, thereby having the legal capacity to enter into a contract. As such, you agree to the terms set out in this contract on your own behalf, or on behalf of children and minors for whom you are the legal guardian.If you are a minor, please have a guardian accompany you in the creation of your account as well as in reading and accepting these terms.Registration and Access: To access our servers, the user must register an account, an act which may be carried out as soon as the user enters our server for the first time. It is through the combination of the registered nickname and password that the user will have access to their account. Your account and the actions carried out through it are your sole responsibility; therefore, you must not share your password with any other individual, and should you do so, you will be responsible for their actions while using the account.Security: Pixelmon Brasil, as a network of Minecraft servers, is responsible for the systemic security of its customers' access and registration data by storing them in encrypted form. We offer an account recovery system through the registration of a security e-mail for the recovery of forgotten or changed passwords (this registration may be carried out on our website and becomes mandatory from the moment the user acquires a VIP package).Where access to an account through its password and recovery via e-mail are both impossible, the user must get in touch through Discord with one of the team members and attach the proof of payment for products purchased in our store no more than 18 months before the loss of access.Other security measures depend exclusively on the user.Trade of Accounts: Pixelmon Brasil is not responsible for the sale or exchange of accounts between users and repudiates such action. Your account is personal and must not be shared with third parties. You as a user are entirely responsible for it, and should any complication arise during a supposed sale or exchange process, we disclaim any responsibility towards the player and their account.Access Block: The blocking of access to a given account may be carried out only by Pixelmon Brasil in the event of the user's breach of these terms.Pixelmon Brasil will block your access to your account solely and exclusively in the event of a breach of the rules of conduct or of any of the terms established in this contract.The rules may be found in item IV of this contract and are valid for all users of our server, website or Discord (community), with the appropriate penalties being applied to players who breach them only by members of our moderation team upon verification of the breach of one or more rules. It is important to state that Pixelmon Brasil grants you the right to request a review of your penalty following an alleged breach of a rule; however, the request for review must be made within 7 days of the application of the penalty, whether it be permanent access block, temporary access block or a block on the use of the in-game chat.Other reasons that may cause the blocking of your access by Pixelmon Brasil are related to the acquisition and use of our products. It is not permitted to carry out a chargeback of any product or service purchased on our network once it has been used or outside the legal period established by the Brazilian Consumer Protection Code (Código de Defesa do Consumidor, CDC) in article 49. Carrying out a chargeback outside the legal period will result in the permanent blocking of the user's access.IV. RULES OF CONDUCT
While connected to our network (Website, Discord and Server), you undertake to comply, in addition to the other terms, with individual rules of conduct that seek to maintain good gameplay and interaction among the users of our services. The breach of the rules of conduct will result in the user's penalization with measures that may range from temporary access blocks (whose duration varies according to the severity and frequency of the infraction) to a permanent block.The rules may change; for that reason, join our Discord and stay attentive to any modifications to the rules.V. PURCHASES, PRIVILEGES AND REFUNDS
Intangibility: By acquiring any products in our store, the customer agrees to acquire virtual, intangible products not subject to physical delivery, for which return or refund cannot occur outside the legal period defined by the Consumer Protection Code for products purchased away from the commercial establishment.Duration: Products with a "Monthly" duration in our store last exactly 30 days after delivery. Products such as (in-game) items or "pokémon" have an effective duration for as long as the server on which they were acquired exists, with a guaranteed minimum duration of 2 months. Should the server on which you acquired a product of “Eternal” duration close before this minimum period, you may get in touch and request the transfer of your product to another server or its conversion into another product of equal value.Refund: Due to the intangibility of our products, refunds will only be provided for products not received within a period of up to 7 business days after acquisition. As a security measure, players who request a refund with the payment platform or card operator without contacting us will have their access permanently blocked from the server, as well as that of all accounts associated with the IP used in the purchase.Support: Pixelmon Brasil undertakes to offer support to its users and customers through our Discord, as well as through the e-mail suporte@pxbroficial.com.br. The minimum period for a response is 2 business days.Products: Pixelmon Brasil reserves the right of delivery of products in accordance with the description provided on the product's page, it being the consumer's duty to review the details and descriptions of each item.VI. PRIVACY POLICY
Pixelmon Brasil is committed to the security and privacy of our users through the protection of their personal data throughout the entire process of registration, use of their account and purchases. Users' registration data will never be sold, disclosed or exchanged, except where such information is requested by court order.Public information (nickname, group on the server, in-game ranking) and general community statistics may be disclosed in advertising campaigns.VII. UPDATES AND CHANGES
Pixelmon Brasil reserves the right to make changes to its products and services as well as to these terms without prior notice, undertaking to notify customers regarding changes.VIII. COMPLIANCE WITH THE CONTRACT TERMS
The use of our servers, website and community Discord is authorized to the user, duly registered, only if they accept our terms of service, thereby being subject to their full application. Disrespect for any term or rule established in this contract may result in the blocking of the user's access as well as the suspension of any active purchased products. The terms may be changed at any time by Pixelmon Brasil, provided that notification of this change is given to its players.IX. TEBEX
